Please read these Terms and Conditions ("Terms") carefully before downloading, installing, registering on, or using the Feast – Food Delivery App or any related website (collectively, the "Service"). By creating an account, placing an order, or otherwise using the Service, you ("User", "you") agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. About the Service
Feast is a technology platform that connects customers with independent third-party restaurants, food vendors, and delivery partners ("Partners"). Feast itself does not prepare food; it only facilitates ordering, payment, and delivery on behalf of its Partners. The actual contract for the supply of food is between you and the Partner restaurant.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a legally binding contract to use the Service.
- By using the Service you confirm that the information you provide is accurate and that you are using the Service for personal, non-commercial purposes only.
3. Account Registration
- You are responsible for keeping your account credentials, OTP, and password confidential.
- You agree to provide accurate, current, and complete information during registration (name, mobile number, email, delivery address).
- You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
- Each user may maintain only one active account. Duplicate or fraudulent accounts may be suspended without notice.
4. Ordering & Acceptance
- Placing an order via the Service is an offer to purchase items from the Partner restaurant at the listed price.
- An order is confirmed only after the restaurant accepts it and you receive an order confirmation in the app.
- Feast / the restaurant reserves the right to refuse or cancel any order at its discretion (for example, in case of out-of-stock items, incorrect pricing, restaurant capacity, suspected fraud, or invalid address).
- You are responsible for ensuring that the delivery address, contact number, and special instructions you provide are correct.
5. Pricing, Charges & Taxes
- All prices displayed in the app are in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
- Additional charges such as delivery fee, packaging fee, convenience fee, and government taxes (GST) may apply and will be shown before you confirm the order.
- Prices and menu availability may vary by location, time, and Partner restaurant, and are subject to change without prior notice.
6. Payment
- Accepted payment methods include online payment (UPI, debit/credit cards, net-banking, wallets) and, where available, Cash on Delivery (COD).
- Online payments are processed by PCI-DSS compliant payment gateway partners. Feast does not store your full card number, CVV, or UPI PIN.
- If a payment is captured but the order is not confirmed, the amount will be auto-refunded to the original payment source within the timelines published by the respective gateway / bank.
7. Delivery
- Delivery times shown in the app are estimates and may vary based on weather, traffic, restaurant preparation time, and delivery-partner availability.
- Someone must be present at the delivery address to receive the order. If no one is available, the delivery partner may wait for a reasonable period and then leave; in such cases, no refund is provided.
- Once the food is handed over, the delivery partner is not responsible for the consumption or further handling of the food.
- You agree to treat delivery partners with respect. Abusive behaviour will not be tolerated and may result in account suspension.
8. Cancellation, Returns & Refunds
- Cancellation by user: Orders may be cancelled free of charge only before the restaurant accepts the order. Once preparation has begun, cancellation may not be possible, or a partial / full charge may apply.
- Cancellation by restaurant or Feast: If we cancel your order (e.g. restaurant unavailable, items unavailable, address unreachable), the full amount paid online will be refunded.
- Refunds: Approved refunds are credited back to the original payment source within 5–10 working days. For COD orders, refunds may be issued as wallet credit (where applicable).
- Quality concerns: If you receive a damaged, spilled, missing, or incorrect item, please raise a complaint with a clear photo within 1 hour of delivery via in-app support or by emailing feast.restro2025@gmail.com. We will investigate with the Partner restaurant and issue a refund or replacement at our discretion.
9. Promotions, Coupons & Offers
- Coupons, discounts, and promotional offers are subject to specific terms displayed at the time of the offer (minimum order value, eligible restaurants, expiry date, usage limit per user, etc.).
- Offers cannot be combined unless explicitly allowed.
- Feast reserves the right to modify, suspend, or withdraw any offer without prior notice.
- Misuse of coupons, referrals, or wallet credits (including using multiple accounts) may result in cancellation of the benefit and suspension of the account.
10. User Conduct
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Place fake orders, refuse delivery without valid reason, or repeatedly cancel COD orders.
- Impersonate any person or misrepresent your identity or address.
- Upload abusive, obscene, defamatory, or misleading content, reviews, or images.
- Attempt to hack, reverse engineer, scrape, or disrupt the Service or its servers.
- Resell items purchased through the Service.
Violation of these rules may result in immediate suspension or termination of your account, and Feast reserves the right to take appropriate legal action.
11. Ratings & Reviews
You may rate and review restaurants and delivery experiences. By submitting a review, you grant Feast a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce your review on the Service. Reviews must be honest, based on actual experience, and free from offensive or unlawful content.
12. Intellectual Property
All content on the Service — including the Feast name, logo, app design, software, graphics, and text — is the property of DABA PRASAD SANTRA (or its licensors) and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission.
13. Third-Party Services
The Service may integrate with third-party providers, such as payment gateways (Razorpay, Stripe, PayPal, Paystack, SSLCOMMERZ, Mercado Pago, Paymob, Flutterwave, bKash – as applicable), Firebase Cloud Messaging, Google Maps, and analytics tools. Your use of those third-party services is governed by their own terms and privacy policies. Feast is not responsible for the acts or omissions of any third-party provider.
14. Account Suspension & Termination
- Feast may suspend or terminate your account at any time, with or without notice, if you breach these Terms, abuse the Service, or engage in suspicious activity.
- You may delete your account at any time using the in-app Delete Account option, or by following the steps at https://restaurant.biriyanifeast.com/data-deletion.
- Upon termination, your right to use the Service ends immediately; however, certain records may be retained to comply with legal and tax obligations (see our Privacy Policy).
15. Disclaimers
- The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
- Feast does not guarantee uninterrupted, error-free, or completely secure operation of the Service.
- Food quality, hygiene, allergen information, packaging, and preparation are the sole responsibility of the Partner restaurant. Feast is not responsible for any harm, illness, or allergic reaction caused by food prepared by a Partner.
- Photos of food items shown in the app are for illustrative purposes only and the actual product may differ.
16. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Feast, its owner, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service. The total aggregate liability of Feast for any claim arising out of or relating to the Service shall not exceed the amount paid by you for the specific order giving rise to the claim.
17. Indemnity
You agree to indemnify and hold harmless Feast, its owner, employees, Partners, and service providers from any claim, demand, loss, or damage (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
18. Force Majeure
Feast shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, riots, strikes, pandemics, government actions, internet outages, or failure of third-party providers.
19. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in India.
20. Changes to These Terms
Feast may update these Terms from time to time. The revised version will be posted on this page with a new "Effective date". Material changes will be notified via the app or email. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
